When using the Duo Telecom services, you must accept and follow this Acceptable Use Policy, as written below:
1. Introduction:
The telephone service is provided by Duo Telecom. Users need to register for a Duo Telecom account (visit the Information Services website for details) to gain access to all the benefits of the service. When you have registered, you are given your own Duo Telecom username, password and telephone number. Each user will have a Duo digital IP phone installed, and Users will be able to login to the phone using their own Duo Telecom account.
In addition, you will be able to install the Duo softphone (telephone software) onto a PC or Laptop to make normal or video calls and messenger other users anywhere. Duo Telecom accounts and the softphone software are also available to your friends and family worldwide.
2. Fees & Charges for Telephone Service:
With Duo Telecom, you can make calls to any telephone user worldwide. When calling other networks and mobile phones, Duo Telecom offers very competitive rates. Voice mail is available to all Duo Telecom users free oif charge.
Users will need credit on their Duo Telecom account before making chargeable calls; this can be done either by bank card on-line or a Duo Telecom top-up card or by monthly billing as appropriate.
Users, friends or family are able to purchase their own digital IP phone (from Duo Telecom ) to connect to the Internet, so they can make calls without the need for a computer. The Softphone software is available for free to everyone and can be downloaded worldwide.
Users must supply their own computer equipment when using the Softphone software and may require a microphone, speakers or headset.
3. Technical Information:
The Duo Telecom telephone service uses the Internet to make calls (Voice over IP). If calling a traditional landline or mobile number, the call remains on the Internet until it reaches the destination country, then “breaks out” onto the normal telephone network locally, therefore calls are less expensive that traditional telephone service providers.
Users require an Internet connection to use either the Desktop IP Phone or the Softphone. Duo Telecom does not guarantee connectivity with all manufacturers’ equipment.
4. Service Support:
Duo Telecom will investigate or repair any reported fault as soon as reasonably possible at no charge, unless the fault was caused by negligence or breach of this Acceptable Use Policy (AUP) in which case, Duo Telecom may make a reasonable charge for any such repair.
Duo Telecom do not guarantee that the service will be fault free. Where possible, Duo Telecom will give advance notice of any disruption to or suspension of the service by displaying notices on the Duo Telecom website and will try to keep such disruption to a minimum. Any breakdown in service will be rectified as soon as possible, but during vacations and over a weekend this may be the next working day.
5. Terms & Conditions:
5.1. The Duo Telecom telephone service connects to the Internet; therefore must be used in accordance with this UAP and the law.
5.2. All users must adhere to copyright and license laws. The service must not be used for any illegal activity.
5.3. Duo Telecom will monitor and check the service (including calls logs) for the purpose of ensuring the correct operation of the network or service, fair allocation of resources and other lawful purposes.
5.4. Your Duo Telecom account and the digital IP phone you own is your responsibility. You will be held accountable for any misuse identified on your account.
5.5. You must not use or allow anyone else to use the service to send a communication which is abusive, offensive, obscene, indecent or menacing, or a hoax call, or which may cause annoyance, inconvenience or needless anxiety to anyone, or which may violate or infringe the rights of any person, or to commit a fraud or criminal offence.
5.6. The services and equipment provided are for business use. The service or any part of it cannot be sold for money or monies worth. Duo Telecom has no liability, whether due to negligence or otherwise, for any losses whatsoever incurred by any business, trade or profession carried on by you or any other person using the services or equipment.
5.7. Any reports or incidents received or monitored by Duo Telecom, regarding unauthorised, illegal access or breach of this AUP will result in immediate disconnection from the service, pending further investigations or disciplinary procedures. Where necessary, information will be passed on to the relevant authorities.
5.9. Duo Telecom will not be liable for any damages or claims of any kind arising from the use of the telephone service or support provided by Duo Telecom Staff of any privately owned equipment, including but not limited to direct, indirect, incidental, punitive and consequential damages, except where expressly agreed by Duo Telecom.
5.11. Duo Telecom reserves the right to disconnect users or services and make changes at any time without notice. Connecting to and using the telephone service implies acceptance and understanding of this policy.
6. Restrictions:
6.1. You shall not remove or alter of our copyright and other intellectual property rights notices included in the System.
6.2 You shall not (except as otherwise expressly permitted by this Agreement or by applicable law) modify, adapt, translate, decompile, disassemble or reverse engineer the System in any manner and shall not create derivative works of the System unless it has received our prior written consent;
6.3 subject always to any rights which You enjoy under applicable law and save as expressly provided in this Agreement, You shall not sub-licence, distribute, market, lease, sell, commercially exploit, loan or give away the System;
6.4 You shall notify Us forthwith if You become aware of any of any unauthorised use of the System by any third party; and
This "Telephone Acceptable Use Policy" is subject to change at any time without notice. Any such changes will be those considered by Duo Telecom in its reasonable option to be necessary for the smooth and safe running of the service.
